By accessing or using HeyChief ("the Service"), operated by HeyChief Inc. ("the Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms apply to all visitors, users, and others who access or use the Service. By creating an account or using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.
HeyChief is an AI-powered educational platform designed to help surgical residents prepare for oral board examinations. The Service provides simulated clinical case scenarios, AI-generated feedback, and performance analytics. The Service is available via web browser and native iOS application.
To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Certain features of the Service are available only with a paid subscription. Subscription fees are billed in advance on a recurring basis as described at the time of purchase. You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of your current billing period. All fees are non-refundable except as required by applicable law.
We reserve the right to change our subscription fees upon reasonable notice. Price changes will take effect at the start of your next billing period. Continued use of the Service after a price change constitutes your acceptance of the new pricing.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
The Service uses artificial intelligence to generate clinical case scenarios, examiner questions, feedback, and performance evaluations. While we strive for accuracy and clinical relevance, AI-generated content is provided for educational and practice purposes only.
The Service is not a substitute for professional medical judgment, diagnosis, or treatment. Clinical scenarios presented by the Service are simulated and should not be used as the basis for actual patient care decisions. Always consult appropriate clinical guidelines, supervising physicians, and institutional protocols when making real patient care decisions.
HeyChief does not guarantee that use of the Service will result in passing any board examination. Board examination outcomes depend on many factors, including individual preparation, clinical experience, and performance on exam day.
The Service and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of HeyChief Inc. and its licensors. The Service is protected by copyright, trademark, and other laws of the United States. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
Users retain ownership of content they submit through the Service, including responses to clinical case scenarios. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content for the purpose of providing and improving the Service.
The Service may integrate with or contain links to third-party services, including payment processors (Stripe), AI service providers (OpenAI, Anthropic), email services (Mailgun), and analytics tools. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of such services is subject to their respective terms and policies.
To the fullest extent permitted by applicable law, HeyChief Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, or goodwill, arising out of or in connection with your use of or inability to use the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.
Our total liability for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you have paid us for use of the Service in the twelve (12) months preceding the claim.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in Oregon.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to the new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised terms.
